Insurable interest required; personal insurances
[§431:10H-204] Extension of benefits. Termination of long-term care insurance shall be without prejudice to any benefits payable for institutionalization if the institutionalization began while the long-term care insurance was in force and continues without interruption after termination. The extension of benefits beyond the period the long-term care insurance was in force may be limited to the duration of the benefit period, if any, or to payment of the maximum benefits and may be subject to any policy waiting period, and all other applicable provisions of the policy. Notices under this subsection shall be confidential as between the commissioner and the parties unless a hearing is held as provided in subsection (b).
(b) If the commissioner has good cause to believe such noncompliance to be wilful, or if, within the period prescribed by the commissioner in the notice given under subsection (a), the insurer does not:
(1) Correct the noncompliance specified by the commissioner; or
(2) Establish to the satisfaction of the commissioner that such noncompliance does not exist,
then the commissioner may proceed with a hearing which shall be subject to the hearing procedure provided in section 431:14-118. [L 1989, c 208, pt of §1]sured members specifically for their insurance shall insure all eligible members, except those who reject such coverage in writing;
(3) An insurer may exclude or limit the coverage on any person as to whom evidence of individual insurability is not satisfactory to the insurer;
(4) The policy shall cover at least twenty-five members at date of issue; and
(5) The amount of insurance under the policy shall be based upon some plan precluding individual selection either by the members or by the union. [L 1987, c 347, pt of §2; am L 2004, c 122, §49]
